Short answer: yes, almost certainly. Waterfront construction is one of the more heavily regulated things a homeowner can do, and the reason is that everything built on a shoreline affects navigation, wetlands and the neighbours.

Who regulates waterfront work

Federal

The US Army Corps of Engineers has jurisdiction over navigable waters. Most dock, pier, boat lift, bulkhead and pile driving work in tidal water touches this. Some projects qualify for nationwide or general permits, which move faster than individual permits.

State

Each state on this coast has its own environmental and coastal management review. Alabama, Florida and Louisiana each run their own process, with their own timelines and their own submission requirements.

Local

City and county building departments, and in many neighbourhoods a homeowners association or riparian rules, add another layer. Setbacks, maximum dock length and pier width are commonly set locally.

How long it takes

Permitting is normally the longest part of a waterfront project, and it is the reason a straightforward dock still takes 2 to 4 weeks start to finish. Complex projects, sensitive habitat and individual Corps permits stretch that. Anyone promising to start work next week without a permit in hand is telling you something about how they work.

What is usually required in a submission

  • Property survey and shoreline dimensions
  • Drawings of the proposed structure with dimensions and materials
  • Water depth information
  • Location relative to the property line and to navigation channels
  • Environmental information where seagrass, wetlands or protected habitat are present

What happens if you skip it

Unpermitted waterfront structures do get discovered, most often at sale, after a storm claim, or when a neighbour complains. The outcomes range from retroactive permitting at cost, to fines, to a removal order at the owner’s expense. It also complicates insurance, because an unpermitted structure can be excluded from a claim.

Repairs are not automatically exempt

Like-for-like maintenance is often treated differently from new construction, but the line is not where most people assume. Changing dimensions, changing materials or increasing the footprint usually triggers review even when the work is described as a repair. Check before you start, not after.
